Selling or leasing a disclosure affected building or area
Real estate agents who are engaged to sell or lease a disclosure affected building or area should ensure compliance with the Building Energy Efficiency Disclosure Act 2010 (BEED Act).
This means you need to provide energy efficiency information (a Building Energy Efficiency Certificate or BEEC) to potential buyers and tenants unless an exemption is in place.

Advertising rules
If you are engaged to sell or lease a disclosure affected building, you must follow the advertising rules.
You must not begin any advertising or invite anyone to buy, lease or sublease a disclosure affected building or area until you have:
- a current registered Building Energy Efficiency Certificate (BEEC); or
- an exemption issued by the Department of Climate Change, Energy, the Environment and Water (the department).
The BEEC or exemption must be registered on the Building Energy Efficiency Register.
The BEEC includes the NABERS Energy for offices rating for the disclosure affected building or area.
The building’s NABERS Energy for offices rating must be included on all advertising materials. There are rules about how the NABERS Energy for offices rating is displayed.
If the disclosure affected building or area does not have a current registered BEEC, the owner or landlord must commence the process to get one.
Ensure you allow enough time for this process. Advertising or offering a disclosure affected building or area without a current registered BEEC is a breach of the Act. The Act imposes penalties for failing to comply with this requirement unless criteria for an exemption is met.
Monitoring compliance
CBD compliance officers investigate property advertising and associated BEECs and exemptions to make sure the required building energy efficiency information is correctly disclosed.
This may include monitoring print and internet listings, banners on buildings, and investigating any breaches reported to us.
Infringement notices have previously been issued to building owners.
